Andre Ayew will appear before the French Ligue 1’s Disciplinary Committee on 25 September to answer charges of incident play.
The Olympique Marseille ace appeared to have kicked Nice player Dario Cvitanich in his sensitive area during a league match on 29 August.
If found guilty, he could be handed match bans.
Ayew failed to secure a move to an unnamed English Premier League side on the transfer deadline day.
